The mission examined whether the death penalty was being applied in a discriminatory manner, and if the conditions on death row met the U.S.\u2019s obligation to prevent and prohibit torture and cruel, inhuman or degrading treatment.\r\nThe mission interviewed death-row prisoners, exonerees and their family members, advocates, legal counsel, and non-governmental organizations in both states, analyzing the information gathered against the backdrop of international human rights law. Based on the interviews conducted and documentary review, the mission concludes that the use of the death penalty in California and Louisiana fails to protect a number of basic rights, rendering the United States in breach of certain fundamental international obligations. Specifically, the mission finds California and Louisiana violate the principle of non-discrimination in the charging, conviction and sentencing of persons to death. Both states treat prisoners condemned to death in a manner that is, at minimum, cruel, inhuman or degrading, and in some cases, constitutes torture.","Year":"2013","Day":"10","Month":"10","URL":"http:\/\/ccrjustice.org\/death-penalty","URLText":"","Quote":""},{"ID":"342","ArticleType":"Essay","PublishDate":"10\/01\/2013","Title":"Get Up Off Your Butt","NewsDescription":"","Year":"2013","Day":"1","Month":"10","URL":"","URLText":"","Quote":""},{"ID":"344","ArticleType":"Essay","PublishDate":"09\/01\/2013","Title":"Classism in America","NewsDescription":"","Year":"2013","Day":"1","Month":"09","URL":"","URLText":"","Quote":""},{"ID":"341","ArticleType":"Essay","PublishDate":"08\/16\/2013","Title":"In Memorial to Sandra","NewsDescription":"","Year":"2013","Day":"16","Month":"08","URL":"","URLText":"","Quote":""},{"ID":"343","ArticleType":"Essay","PublishDate":"08\/01\/2013","Title":"Moratorium","NewsDescription":"","Year":"2013","Day":"1","Month":"08","URL":"","URLText":"","Quote":""},{"ID":"340","ArticleType":"Essay","PublishDate":"07\/10\/2013","Title":"Book about Kevin Cooper wins new award","NewsDescription":"Scapegoat: The Chino Hills Murders and the Framing of Kevin Cooper by J. Many of you, his supporters and anti-death penalty activists, went to his hearing in San Francisco in January, where we packed the courtroom inside and rallied in support of Kevin outside -- even though none of the judges were even present in the courtroom for the hearing. \r\n\r\nIt probably goes without saying that this ruling is disappointing, although not entirely unexpected, given what we know about the criminal injustice system. The next step will be appealing for a hearing in front of the larger panel of 9th circuit (an en banc hearing). Keep in mind that it was the en banc panel that granted him the last minute stay of execution in 2004. \r\n\r\nBelow is an article from the Los Angeles Times on the ruling. Note the section describing the separate, concurring opinion written by a member of the 3-judge panel, Judge M. Margaret McKeown. The opinion indicts the AEDPA (Anti-terrorism and Effective Death Penalty Act) for its severe limitations in general and in this case, limiting the ability to examine evidence and rule on significant issues that are now procedurally barred. She describes in detail some of the many \"troubling\" issues surrounding the evidence in the case, including the destruction and mishandling of evidence. \r\n\r\nMcKeown writes that she was \"troubled that we cannot, in Kevin Cooper's words, resolve the question of his guilt 'once and for all.' \" She also writes: \r\n\r\n\"Significant evidence bearing on Cooper's culpability has been lost, destroyed or left unpursued, including, for example, blood-covered coveralls belonging to a potential suspect who was a convicted murderer, and a bloody t-shirt, discovered alongside the road near the crime scene. The managing criminologist in charge of the evidence used to establish Cooper's guilt at trial was, as it turns out, a heroin addict, and was fired for stealing drugs seized by the police. Countless other alleged problems with the handling and disclosure of evidence and the integrity of the forensic testing and investigation undermine confidence in the evidence.\" \r\n\r\n\"The habeas process does not account for lingering doubt or new evidence that cannot leap the clear and convincing hurdle of AEDPA. Instead, we are left with a situation in which confidence in the blood sample is murky at best, and lost, destroyed or tampered evidence cannot be factored into the final analysis of doubt. The result is wholly discomforting, but one that the law demands.\" \r\n\r\nIn essence, the court cannot definitively prove guilt, but upholding his death sentence anyway is the law. This tells you not only what is wrong with this ruling against Kevin Cooper, but what is wrong with the law. \r\n\r\nThis is not justice. \r\n\r\nThe opinions are available online at http:\/\/extras.mnginteractive.com\/live\/media\/site203\/2007\/1205\/20071205_104338_Dec20079thCtRuling.pdf. The first is the majority opinion, followed by McKeown's concurrent opinion. \r\n\r\nWe will keep you posted with further developments. Please visit http:\/\/www.savekevincooper.org and http:\/\/www.nodeathpenalty.org for updates. We need to rebuild the activism around Kevin's case that led to his stay of execution. In a time when executions are on hold in California and across the country, we need to keep up the sense of urgency around fighting for justice for Kevin Cooper, and against ALL executions. \r\n\r\nIn Solidarity, \r\nCrystal Bybee ","Year":"2007","Day":"4","Month":"12","URL":"http:\/\/www.indybay.org\/newsitems\/2007\/12\/26\/18468935.php","URLText":"","Quote":""},{"ID":"207","ArticleType":"Documents","PublishDate":"10\/04\/2007","Title":"Memo from San Quentin","NewsDescription":"","Year":"2007","Day":"4","Month":"10","URL":"","URLText":"","Quote":""},{"ID":"81","ArticleType":"Essay","PublishDate":"08\/01\/2007","Title":"The District Attorney","NewsDescription":"","Year":"2007","Day":"1","Month":"08","URL":"","URLText":"","Quote":"We did not know until 1998 that the district attorney was withholding material exculpatory evidence."},{"ID":"87","ArticleType":"Essay","PublishDate":"08\/01\/2007","Title":"Free as in Freedom","NewsDescription":"","Year":"2007","Day":"1","Month":"08","URL":"","URLText":"","Quote":"No people can be truly or totally free if they have to live in a state of constant fear."},{"ID":"86","ArticleType":"Essay","PublishDate":"08\/01\/2007","Title":"The One Place","NewsDescription":"","Year":"2007","Day":"1","Month":"08","URL":"","URLText":"","Quote":"In our death chambers, there were no Whites Only electric chairs and no Colored Only electric chairs.
